1. INTRODUCTION

Welcome to Dhun Dhhunak (“App”).
By downloading, installing, accessing, or using this App, you agree to be bound by these Terms and Conditions (“Terms”).
If you do not agree with any part of these Terms, you must immediately discontinue use and uninstall the App.

The App is provided “as is” and “as available.”
No warranties, express or implied, are given regarding performance, reliability, or results.
To the fullest extent permitted by law, Dhun Dhhunak Frequency Research and Analysis Private Limited, its founder, affiliates, partners, employees, and developers shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the App or reliance upon its content.

2. ELIGIBILITY

(a) You must be at least 16 years of age to use this App.
If you are under 16, a parent or legal guardian must provide consent and actively supervise usage.

(b) By using the App, you confirm that you are legally permitted to use this service under the laws and regulations applicable in your country or state.

(c) You represent that you have the legal capacity to enter into these Terms.

(d) If you use the App on behalf of an organization or other entity, you represent that you have the full authority to bind that entity to these Terms, and that such entity accepts responsibility for your use.

3. SUBSCRIPTIONS AND PAYMENTS

(a) Certain services within the App operate on a subscription basis. By purchasing a subscription, you authorize recurring billing until canceled prior to the renewal date.

(b) All payments are processed through verified third-party payment providers. The App does not collect, process, or store credit-card, UPI, or banking credentials.

(c) Refunds are available only where required by law and are not applicable for completed digital service periods. Processing time for eligible refunds is between 18 and 27 business days to the user’s account.

(d) Subscription fees may change at any time with reasonable notice. Continued use of paid features after any change constitutes acceptance of revised pricing.

(e) Users are solely responsible for ensuring that payment information is accurate, current, and sufficient to maintain uninterrupted access.

4. USER RESPONSIBILITIES AND ACCEPTABLE USE

(a) The App is created solely for wellness, mindfulness, and relaxation. It must not be used as a replacement for medical, psychiatric, or professional advice.

(b) Users are responsible for ensuring that their use of the App complies with all local, state, and national laws within their jurisdiction.

(c) Users are personally responsible for their own health, safety, and well-being while using the App. The Company does not assume liability for any adverse health effect or perceived outcome.

(d) Users agree not to misuse the App, including but not limited to:
 (i) attempting unauthorized access to servers or databases;
 (ii) altering, decompiling, reverse-engineering, or redistributing the App’s code or content;
 (iii) uploading malware, viruses, or any harmful code;
 (iv) reselling or commercially exploiting the App without written consent.

(e) Users must keep login credentials confidential and must not share accounts with unauthorized persons.

(f) The App may include AI-generated responses and frequency recommendations. Such AI content is experimental; accuracy, tone, or completeness are not guaranteed.

5. MEDICAL AND LEGAL DISCLAIMER

(a) The App does not provide medical, psychological, diagnostic, or professional advice.

(b) All audio, frequency, and text content are intended for general wellness, meditation, and educational purposes only.

(c) Users must not discontinue or modify any prescribed medical treatment or medication based on App content.

(d) Users should consult a licensed physician or mental-health professional before using the App, particularly if they have pre-existing conditions, anxiety disorders, or are pregnant.

(e) The Company and its developers do not guarantee the effectiveness of any content or sound frequency. Individual results vary.

(f) AI-generated guidance may contain inaccuracies, contextual errors, or incomplete statements. Use and interpretation are entirely at the user’s own discretion and risk.

(g) By using this App, you expressly acknowledge that Dhun Dhhunak, its founder, directors, and affiliates are not liable for any emotional, physical, or mental outcomes arising from use, misuse, or interpretation of the content.

(h) Users agree to assume full responsibility for their own choices and actions while engaging with the App.

6. RESTRICTIONS AND PROHIBITED CONDUCT

(a) Users must not:
 (i) use the App for any illegal, defamatory, or harmful purpose;
 (ii) circumvent security features;
 (iii) introduce code or data that may impair functionality;
 (iv) engage in harassment, hate speech, or exploitation;
 (v) copy, record, or redistribute proprietary audio or visual materials.

(b) Violation of these Terms may result in immediate suspension or permanent ban without refund or prior notice.

7. LIMITATION OF LIABILITY

(a) To the fullest extent allowed by law, the Company, its founder, officers, and partners shall not be liable for:
 (i) any indirect, incidental, or consequential damages;
 (ii) loss of data, profits, or emotional well-being;
 (iii) unauthorized access to or alteration of user transmissions;
 (iv) delays, failures, or errors beyond our control.

(b) The App does not warrant that it will operate error-free, uninterrupted, or compatible with every device.

(c) Users agree to indemnify, defend, and hold harmless Dhun Dhhunak Frequency Research and Analysis Private Limited and its representatives from all claims or demands resulting from use or misuse of the App or violation of these Terms.

(d) Use of this App and reliance upon its AI or audio outputs are entirely at the user’s own risk.

8. ACCOUNT TERMINATION

(a) We may restrict, suspend, or terminate user access without prior notice if these Terms are violated, if suspicious activity is detected, or as required by law.

(b) Subscription fees are non-refundable if termination results from breach of policy.

(c) Users may delete their accounts voluntarily; however, refunds will not be issued except where legally required.

(d) Upon termination, all licenses granted under these Terms automatically cease.

9. DATA PRIVACY AND SECURITY

(a) By using the App, you consent to data collection and processing as outlined in our Privacy Policy.

(b) We adhere to the Digital Personal Data Protection Act (2023) and global best-practice principles derived from GDPR and CCPA.

(c) We employ encryption, secure servers, and limited-access controls to protect personal data.

(d) No system is fully secure; users acknowledge and accept this risk.

(e) We are not responsible for security failures or data leaks caused by external third-party systems.

(f) Users should update passwords regularly and maintain responsible device hygiene.

10. INTELLECTUAL PROPERTY AND COPYRIGHT

(a) All audio frequencies, compositions, text, visual design, source code, AI models, and branding elements are the exclusive property of Dhun Dhhunak Frequency Research and Analysis Private Limited.

(b) Every work in the App is copyright-protected under Indian and international intellectual-property laws.

(c) All recordings and compositions are original or lawfully commissioned, and formal copyright registration and licensing processes are currently underway as part of our global compliance initiative.

(d) Users are expressly prohibited from:
 (i) copying, redistributing, reproducing, sampling, or reselling any content;
 (ii) uploading our copyrighted work to external platforms;
 (iii) using our content for commercial or promotional purposes without written permission.

(e) Any unauthorized use of Dhun Dhhunak’s assets constitutes copyright infringement and may result in civil or criminal proceedings.

11. MODIFICATIONS TO TERMS

(a) We may revise or update these Terms at any time without prior notice.

(b) Significant changes will be displayed within the App or on our website.

(c) Continued use of the App after such updates constitutes your acceptance of the modified Terms.

(d) Users are encouraged to check this page periodically to remain informed of the latest version.

12. GOVERNING LAW AND DISPUTE RESOLUTION

(a) These Terms are governed by and interpreted according to the laws of India.

(b) Any dispute arising out of these Terms shall fall under the exclusive jurisdiction of competent courts in India.

(c) Users agree not to file claims in jurisdictions outside India where such action is restricted.

(d) Any legal claim must be initiated within one (1) year of the cause of action; otherwise, the claim is permanently barred.

(e) International users are responsible for compliance with their respective local laws. Dhun Dhhunak is not liable for conflicts or differences arising from jurisdictional variation or future amendments to foreign legislation.

13. INTERNATIONAL USERS

(a) The App is accessible globally, but Dhun Dhhunak does not guarantee that its features comply with every national law or regulation.

(b) Users outside India must ensure that local legislation allows the download and use of such wellness services.

(c) Use from restricted territories is done entirely at the user’s own risk, and the Company bears no responsibility for any regulatory conflict.

14. ENTIRE AGREEMENT AND SEVERABILITY

(a) These Terms, together with the Privacy Policy, constitute the entire agreement between the user and Dhun Dhhunak regarding the use of the App.

(b) If any clause is deemed invalid or unenforceable by a court, the remaining provisions shall continue in full effect.
